Every mining project is subject to an operational life cycle, which invariably leads to its eventual closure or abandonment. There can be a number of reasons for which a particular mine is either closed or abandoned, and in almost circumstances those particular reasons need to be effectively integrated by legal counsel into the procedure through which that particular mining site is shut down (so as to minimize any future consequences from the closure process).

Key considerations in a mine closing process include: employee termination and severance; mine reclamation approval, bonding and/or funding, collateral financial assurances; and site remediation and abandonment liabilities and certification. Nevertheless, it is the specificity of every scenario that is ultimately going to dictate what steps are to be undertaken and how they are to be implemented.
